OVER REVs in 5 & Lost Deposit

first of all I've got to say this forum is great.

So the past week has been eventful, i put a deposit down (£500) on a midnight blue 2007 C2S with Aerokit and turbo alloys on friday, i found the car on Ebay. The seller described the car as "every thing working exactly the same as the day it left the factory, and also "PLEASE DONT COMPARE THIS TO STANDARD ABUSED PORSCHE" so i booked it into Porsche Leeds for a 111 point check. i live in London the plan was my Mam and Dad would drive the car down for me this friday. My dad went to see the car and said it was presented messy and dirty inside, he didn't drive it but was driven in it with the sports exhaust on.

This is what came back all with crosses in the red box - Requires Urgent attention

MAJOR service required inc spark plugs
break-fluid - requires changing
NON gen Battery
Coolant condition/leaks - Leaking from front pipes
Engine oil level/leaks - Both cam chain tensioners leaking

Rear Discs - Worn below min thread
Front wipers - Smear screen
Steering wear/condition - Excessive play in Rack Arms

Added notes
1 Rads blocked with Debris
2 Coil packs cracked
3 Towing eye missing
4 Locking Wheel nut missing
5 TPM in-op Reqs 2 new sensors on front
6 Cup Holder Broken

5 Over rev in 5 30 hours ago Req compression and leaka

I felt this was in contradiction to how he advertised the car as so asked for my deposit back.

Regardless of the over revs it was about 4-5Ks worth of work so i asked for my deposit back as i felt this was too much work,

I wanted to ask people their opinion on this as he will not give me my deposit back saying theres nothing wrong with the car and its what you would expect from a 6 year old car, which contradicts what he said to my father which was " i don't know why he wants to send it to Porsche its only 5 years old its fine" As i see it he miss advertised the car.

Also i feel bad as it has high over revs and i can't see him disclosing that to a new buyer. I mean as i'm new to Porsche what could the over rev do to the engine?

Ive found myself a different Black 997 C2S with sports exahust from Lawton Brook, its going to Porsche tomorrow for 111 if it checks out i will drive it home tomorrow, if not the search continues.

Some of those are pretty minor and I would happily ignore, non-genuine battery, so what...
But there are some pretty major ones which to me sound like it wasn't as described. I would certainly be expecting a refund as it clearly doesn't match the description, in particular the leaks and missing items!

I guess technically just because it has over-revs it doesn't mean that it isn't working as it was when it left the factory, but I doubt it left with worn parts on it and requiring an expensive service. Did it have a reasonable service record with it?

The car needs a good service, spark plugs etc. That'd be a grand...
But some of it? I mean, calling out that wipers smear? And that the battery isn't oem?

For brake fluid did they test it, or just look at the service book?

Opcs are looking for work, and wanting to show they've found something for the money you've given them. They may also want to scare you into only buying from opcs...

I'd be tempted to have a proper conversation with an Indy... perhaps strasse or porschatek if the car is up this way?
 
Get your money back.

If he cuts up rough, report to eBay and take out a small claims court claim.
 
thanks guys, it was a private listing but he has another 8-9 private listings selling cars, he told me it has FPSH.

I thought as its 4-5K's worth of work its more than minor bits and bobs.

I've got to say Porsche dealership customer service was fantastic.

thanks, i wouldn't feel happy with this car now, not with over revs in 5, being my first Porsche i want to find one in better condition.

Hes flat refusing to give me my deposit saying theres nothing wrong with the car.
 
The company that make these cars say there is something wrong with it. Only time would tell if the over rev has caused an engine issue.

Is he registered as a dealer on ebay, is he paying tax as a dealer??? What defines a dealer, I though the law tightened up on these rules.
 
I was reading if you sell more than 3 cars in a 12 month period your are seen as a dealer in the eyes of the law.
 
I used Leeds for my 111 point check Pre purchase and they will comment on the smallest detail

Which is as I would expect, I'd want to know all the little things before making a decision on a large amount of cash

None of that stuff is major but good to know how much you need to spend to take into account it's value

I didnt though realise overev reports were part of a 111 point check or did you specifically ask for it?

Who paid for the check?

What conditions were agreed with the deposit?

Open a eBay 'item not as described/not received case and explain the circumstances and back up with a copy of the 111 point check if requested. eBay are buyer friendly and generally side with the buyer over the seller so you will get your deposit back as long as you paid by PayPal.

If you paid by any means outside of eBay it will take a small claims court case to get your money back
 
First and foremost never ever leave a deposit on a unseen used car -there is never any need :nooo:


Now hopefully the useful stuff-
Getting you deposit back is going to be a battle of wills :bandit:


Do you have a receipt for your deposit? If so what does it say ?
Dose it stipulate a time limit within when you have to complete the transaction by?
If not , email the guy back and tell him you are happy to complete the deal but it is going to take you a couple of months to sort the money out. If this is not satisfactory to him then he can return the deposit to you, and you will lift him from his obligation not to sell the car /advertise the car. (Otherwise you will see him in a couple of months, also remind him not to drive the car in the meantime as you have left a deposit on a car with specific millage)

I think the right thing to do is cover his cost to advertise the car, and any fuel /time he incurred getting the car to the Porsche centre and back
 
He has to pay it back...... If not, pursue through small claims and you'll get back in the end.

Start with a few letters first.
