Unsatisfactory SOR experience review with Gmund Cars Ltd.

Gmund Cars Review : NEGATIVE.

I first visited Gmund Cars in July 2018 and was initially very impressed. The director Andrew Mearns said he really liked my car, a silver Carrera 3.2 with red interior, a very nice low mileage car in excellent condition. He offered to sell it on an SOR basis for me and we agreed the sum to be returned and the agreement was signed.

Andrew contacted me when he had a prospective buyer in late October 2018. I agreed to take a slightly lower amount to conclude the sale. By 16th Nov I'd not heard if the sale had gone through so chased up and was advised car was going to the new owner in Pontefract on 27th November. That date came and went, I chased up and was advised they were waiting for black over-mats and agreeing what radio the customer wanted (allegedly). On 17th Dec I received the notification from DVLA dated 12/12/18 informing me I was no longer the registered keeper. Gmund didn't contact me to say the sale had gone through. I contacted them and was advised I'd receive payment by the end of the week. That didn't happen.

First week of Jan 2019 I contacted them asking where the payment was and Andrew reckoned he'd been off with man flu, further reassurances payment would be sorted. Payment was not forthcoming! He then disappeared on a nice foreign holiday on the proceeds of the sale of my car. There have been endless promises made since then that payment would be made. All I have received was one payment of £5k on the 22nd Feb. leaving a very substantial sum outstanding.

At the start of March Andrew called me with "good news" that he'd just sold a £60k car and would now be able to pay me in full. Every excuse in the book has followed and no payment received. Google has revealed other unsuspecting customers suffering similar treatment dating right back to 2013. It's an absolute nightmare!
 
So sorry to hear this but unfortunately it is a tale we hear repeatedly.

There was another gentleman on DDK who suffered exactly the same as you recently....

And various other people always come out of the woodwork sharing similar stories whenever someone goes public about it, probably having been too embarrassed or simply annoyed to say anything at the time.

It's disgusting that someone would use other people's hard earned money to prop up their business.

I hope you get paid soon and can put this all behind you, I'm sure it must be incredibly stressful.

I am afraid that ' Personal visit ' appears to be the required action here.....
sometimes it requires the ' personal touch' to convince a chap to pay up ....
be persuasive .... don't rely on his word ....
 
dpc7 is your car still listed on his site? maybe share the link to the ad and car's reg and the new owner will come forward
 
A question for you dpc7, have you "gone legal" yet? If this was me, I'd have been to see a solicitor before Christmas, because as it stands you might be one of several unsecured creditors waiting for their money. If the company becomes insolvent........well, let's not think about that.
You need to take proper legal advice immediately, if you haven't already done so. Good luck, hope it ends well for you.

More widely, it calls into question the whole SOR model, unless you are sure that the dealer is reputable and, more importantly, solvent.

Yes I am of course taking advice, I will pursue all avenues to retrieve what is owed. It has given me plenty of time to think of the best course of action for sure. The last straw for me was when he called me to say he had good news and would pay in full and several weeks later still no payment forthcoming despite me hounding him.

Reg no. is C765 VPK - I was told it was sold to somebody in Pontefract, whether or not that is true I don't know - One of the excuses for delay in concluding the sale was that it was supposedly being transferred onto a private plate for the new owner, but I think that may also be untrue as it still shows under this reg no. on the DVLA site, you can see the consistently low mileage on the MOT history.

It's a pretty distinctive car with what my friend described as a "Porn Star interior"
 
Taken on face value it's all great, the problems come with the unsuspecting owners of cars there on SOR. Some dealers apparently think it's ok to use the proceeds from sales of cars they don't own to finance their business.

Years ago, we had a very, very straight, no nonsense lawyer (sadly long since retired) who we used for all our property transactions.

His advice in regard to outstanding debts was very straightforward and concurs with 911TEL: visit in person, look like you (or your accompanying 'legal advisers') mean business, but do nothing illegal, make no threats (technically assault) just be very persuasive.[/i]

Sorry OP for your hassles. Their bad cash management isnt your problem
