New tyres with 2012 datecode

Under their terms & conditions, para 4 they say
The DOT refers to the date of manufacture of the tyre. It is a four-digit number indicating the week and year of the date of manufacture. All tyres manufactured less than 36 months ago are considered as new. No claim can be accepted by AD TYRES INTERNATIONAL SLU for tyres manufactured within the last 36 months.
You seem to be able to have them replaced
